ImageGen 2 is an independent platform that uses OpenAI's GPT Image 2 API for image generation. We are not affiliated with, endorsed by, or sponsored by OpenAI.

2. Description of Service

ImageGen 2 provides a web-based interface for generating artificial intelligence images based on text prompts, powered by OpenAI's GPT Image 2 model. The Service requires the consumption of "credits" which are allocated based on your subscription plan or one-time purchases.

3. User Conduct and Content Rules

You agree not to use the Service to generate, upload, or share content that is:

• Illegal, harmful, threatening, or abusive.
• Sexually explicit, non-consensual intimate imagery, or child sexual abuse material (CSAM).
• Hate speech, harassing, or promoting violence against any group or individual.
• Infringing on any third-party intellectual property rights, including copyrights and trademarks.

We reserve the right to suspend or terminate accounts that violate these content rules without prior notice or refund.

4. Intellectual Property and Commercial Rights

Subject to your compliance with these Terms, you are granted full commercial rights to the images you generate using our paid plans. You may use the generated images for commercial projects, marketing, and products. However, because AI-generated images are created via algorithms, you acknowledge that copyright laws regarding AI-generated art may vary by jurisdiction, and we cannot guarantee that you will be able to claim exclusive copyright ownership over the generated content.

5. Payments, Subscriptions, and Refunds

All payments are securely processed through our third-party payment providers. Subscriptions auto-renew unless canceled before the next billing cycle. Due to the extremely high computational costs associated with AI image generation, we maintain a strict no-refund policy. We do not provide refunds or credits for partial subscription months, unused credits, or accidental purchases once the generation process has been initiated.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. AI generation is inherently unpredictable. We do not warrant that the generated images will meet your exact expectations, be free of artifacts, or that the service will be uninterrupted or error-free.

7. Limitation of Liability

In no event shall ImageGen 2 or its operators be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service or the images generated by the Service.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the date at the top of this page. Your continued use of the Service following such updates constitutes your acceptance of the revised Terms.
